1. Introduction
These Terms of Service (the “Agreement”) constitute a legally binding agreement between you ("User") and Kadir Kırca("Provider", "We", "Us", or "Our"), operating under the laws of the Republic of Turkey (Tax Office: KAŞ, Tax No: 5570741162). This Agreement governs your access to and use of the Ask Bar Chrome extension ("Ask Bar") and any associated services, websites, or documentation.
By installing, accessing, or using Ask Bar, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations, including those of the Republic of Turkey. This Agreement applies to all visitors, users, and others who access the Service. If you do not agree with any part of these terms, you are expressly prohibited from using the product and must discontinue use immediately.
2. Description of Service
Ask Bar is an advanced AI-powered browser extension designed to enhance productivity by overlaying a smart, interactive floating bar on any visited web page. It functions as an interface layer that analyzes page content (DOM elements) and connects with user-selected third-party Artificial Intelligence providers (including but not limited to Gemini, Claude, ChatGPT, Grok, DeepSeek).
The Service returns context-aware responses, summaries, translations, or explanations based on the data processed. Ask Bar also includes specialized productivity features such as:

Research Mode: For deep-diving into specific topics across multiple sources.

Spot Bar Mode: For quick, on-the-fly queries without leaving the current context.

Snap Screen Mode: For analyzing visual content within the browser.

Tab Dock Mode: For managing and organizing browser tabs efficiently.
Please note that Ask Bar acts as a facilitator for these AI interactions; we do not generate the AI content ourselves and do not guarantee the availability of third-party AI models.
3. Accounts and Registration
To access the full functionality of Ask Bar, users must register and create an account using a valid email address and a secure password. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

Security Responsibilities: You agree to notify us immediately of any unauthorized access to or use of your account. We cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.

Account Integrity: We reserve the right to suspend, disable, or terminate accounts at our sole discretion, without prior notice, if we suspect misuse, fraudulent activity, attempted security breaches, or any violation of these Terms.

Data Retention on Deletion: Upon a verified request for account deletion, your personally identifiable information (email and password) will be permanently deleted from our Supabase systems. However, we may retain anonymized, aggregated analytics data that does not identify you personally for the purpose of improving our service.
4. Payment, Subscription, and Redemption Codes
Ask Bar provides flexible access models, including direct purchases via Stripe and redemption codes acquired through authorized third-party partners offering lifetime access deals.

Direct Purchases & Trials: Users purchasing directly through our website are entitled to a 3-day free trial to evaluate the Service. For these direct transactions, we offer a strict 14-day refund policy from the date of purchase. To request a refund, you must contact support with proof of purchase.

Third-Party Redemption Codes: If you accessed Ask Bar using a redemption code purchased from a third-party platform (e.g., AppSumo or similar marketplaces), your purchase is subject to the terms, conditions, and refund policies of that specific vendor. We do not process refunds for payments made to third parties; such requests must be directed to the vendor. Codes must be activated within the Ask Bar dashboard to be valid.

Definition of Lifetime Access: "Lifetime Access" refers to the lifetime of the Ask Bar product, not the user's life. This means you will have access to the Service for as long as the Product is available and supported by the Provider.

Future Pricing Models: The Provider reserves the right to modify pricing structures or introduce subscription models for new users or new premium features in the future. Existing lifetime license holders will retain access to the features included in their original deal terms.

Payment Security: All direct financial transactions are processed securely via Stripe. We do not store or have access to your full credit card information.
5. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with this Agreement. You explicitly agree not to:

Illegal & Harmful Use: Use Ask Bar for any illegal, abusive, harassing, defamatory, or fraudulent activity, or to generate content that promotes hate speech or violence.

Reverse Engineering: Attempt to reverse-engineer, decompile, disassemble, or derive the source code of the extension or any part of the Service.

System Interference: Use any robot, spider, crawler, scraper, or other automated means to access the Service or exploit it to interfere with the performance of websites, our systems, or the integrated AI providers.

Account Sharing: Share your account credentials with multiple individuals or resell your access to the Service without express written permission.
Violation of this section constitutes a material breach of this Agreement and may result in immediate and permanent account termination.
6. Intellectual Property Rights
While Kadir Kırca acts as the authorized service provider and seller within this jurisdiction, it is acknowledged that all underlying intellectual property rights in Ask Bar—including but not limited to the source code, visual interfaces, interactive features, design, documentation, logos, and proprietary algorithms—remain the sole and exclusive property of KIRCA LIMITED (Registered in England & Wales, D-U-N-S 229537062).

Limited License: Subject to your compliance with these Terms, you are granted a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the software solely for your personal or internal business purposes.

No Transfer of Rights: Nothing in this Agreement transfers any ownership rights or interest in the Intellectual Property to you. Any feedback, comments, or suggestions you may provide regarding Ask Bar is entirely voluntary and we will be free to use such feedback as we see fit and without any obligation to you.
7. Data Storage, Security, and Privacy (KVKK & GDPR)
Ask Bar is committed to data privacy and employs a hybrid storage architecture to minimize data retention risks:

Local Storage: To ensure privacy and speed, the majority of your chat history, session contexts, and temporary data are retained solely in your browser's local storage (Chrome Storage API). We do not systematically harvest your browsing history.

Cloud Storage: Essential user data, such as authentication credentials (email, hashed password) and license status, are stored on secure, enterprise-grade Supabase servers located in the United States.
Compliance: Your data is processed in strict accordance with both the General Data Protection Regulation (GDPR) for European users and the Turkish Law on the Protection of Personal Data (KVKK - Law No. 6698).

Encryption: All data in transit between the extension, our servers, and third-party APIs is encrypted using industry-standard HTTPS (SSL/TLS) protocols.

Password Security: Passwords are never stored in plain text; they are hashed using SHA-256 or equivalent cryptographic standards before storage.
8. Third-Party Integrations
To function correctly, Ask Bar relies on interoperability with various third-party services. You acknowledge that we have no control over the availability or performance of these external services:

AI Providers: The core intelligence is provided by third parties such as Gemini (Google), Claude (Anthropic), OpenAI, xAI, and DeepSeek. We are not responsible for the accuracy, quality, or reliability of the content generated by these providers, nor for any "hallucinations" or errors in their output.

Infrastructure & Tools: We utilize Supabase for backend services, Cloudflare Workers for edge computing, and Stripe for payments.

Analytics: We may use tools like Google Analytics, Meta Pixel, and others to analyze usage patterns.
By using the Service, you acknowledge that data transmitted to these providers is subject to their respective privacy policies and terms of service. If a third-party AI provider discontinues their API or bans your access, Ask Bar may be unable to function as intended.
9. Limitation of Liability
ASK BAR IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. KADIR KIRCA AND KIRCA LIMITED EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE PROVIDER, THE IP OWNER, OR THEIR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
(I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE;
(II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE;
(III) ANY CONTENT OBTAINED FROM THE SERVICE (INCLUDING AI-GENERATED ADVICE); OR
(IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
10. Termination
We may, at our sole discretion, suspend or terminate your account and block access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. Locally stored data will be deleted from your browser instance, and your account data will be removed from our servers (except for data we are required to retain by law or for legitimate business purposes such as fraud prevention).
11. Modifications and Updates
Kadir Kırca reserves the right to modify, amend, or replace these Terms at any time at our sole discretion.

Notification: We will provide reasonable notice of any significant changes via the email address associated with your account or through a prominent notice within the extension.

Acceptance: Continued use of Ask Bar after any such changes become effective constitutes your binding acceptance of the new Terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
12. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.
Any dispute, controversy, or claim arising out of or in connection with this Agreement, or the breach, termination, or invalidity thereof, shall be subject to the exclusive jurisdiction of the Courts and Execution Offices of Istanbul.
